The Fair Work Act (FWA) states in Section 93 that employers can require an employee to take leave IF it is in an Award or Enterprise Agreement however, there is no such clause in the Victorian Public Health Sector Agreement.

It might suit some staff to take leave at this time however, you can’t be compelled to take leave and your employer has an obligation under the Agreement to notify the Union and consult.

“Depending on your particular workplace, there may be other alternatives your management could consider that would allow you to retain your leave entitlements,” said Linda Jenkin, VHPA Lead Organiser.
