The VHPA has been successful in obtaining a payment of 17 weeks pay for a Health Professional who was unfairly dismissed by their employer.
The member was employed at a public hospital and was terminated on the basis of alleged unsatisfactory performance, an allegation that the VHPA believe was unfounded.
Despite attempts to resolve the matter in the immediate aftermath of the termination, this was unsuccessful and the VHPA lodged an unfair dismissal application with the Fair Work Commission.
During the unfair dismissal conciliation, the employer agreed to pay the Health Professional 17 weeks pay to settle the matter. When combined with the 4 weeks notice they were paid, the VHPA member received a total of 21 weeks pay, close to the maximum of 26 weeks pay an employee can receive in an unfair dismissal arbitration.
